How much notice does a landlord have to give to enter? In England, the statutory condition-inspection right requires 24 hours' written notice and a reasonable time of day; it is not permission to force entry. Government tenant guidance also says landlords should give at least that notice for inspections or repairs, except emergencies needing immediate access.

The practical mistake is treating “notice sent” as “visit agreed”. A property team needs a clear purpose, a workable appointment and an access arrangement, especially where the tenant cannot be home or has already raised a concern.

This guide focuses on residential renting in England. Do not apply its statutory explanation or templates as a legal notice for Wales, Scotland or Northern Ireland without checking the local rules. The suggested wording is an access request to adapt, not a substitute for advice in a contested case.

How much notice does a landlord have to give to enter?

Section 11(6) of the Landlord and Tenant Act 1985 implies an access covenant where its repairing covenant applies. It permits the landlord, or someone authorised by the landlord in writing, to enter at reasonable times of day, on giving 24 hours' written notice to the occupier, to view the condition and state of repair. Read the statutory wording for that specific purpose.

That inspection provision is not a general right to enter for anything the owner wants. Identify whether the proposed visit concerns condition, an agreed repair, a safety check or a viewing, then check the appropriate legal and contractual basis.

Shelter distinguishes repair access from viewings and sale visits, for which the agreement matters. Its guidance also says a landlord should not enter without permission merely because they hold a key. Do not use the inspection rule to justify an unrelated visit.

Build the written request around the actual work. “Property visit” gives the resident little information about whether someone needs access to a bedroom, a boiler cupboard or the whole home. Specify the purpose and scope before asking them to arrange their day around it.

Does written notice let an agent enter without agreement?

No routine process should assume silence means consent. Tenants have the right to live undisturbed, often described as quiet enjoyment. Shelter's access guidance warns that entering without notice or permission could be harassment and advises arranging a suitable time.

For agency practice, seek an explicit appointment response and record any agreed use of management keys. If the tenant says the time does not work, ask for an alternative rather than announcing that a contractor will enter anyway. Distinguish a rejected appointment from a refusal of all access.

If the tenant agrees to entry while absent, record who may attend, the purpose and the agreed window. Keep key custody and return in the job record. Do not infer continuing permission for future visits from agreement to a particular appointment.

Room-only lets also need care. Shelter explains that a landlord may be able to enter shared areas for a good reason while still needing permission for the tenant's bedroom. Confirm what the tenant actually rents rather than applying a whole-property assumption to every shared house.

When is immediate access justified?

The government's tenant guidance recognises an exception where there is an emergency requiring immediate access. That is different from an appointment being inconvenient to rearrange or a contractor having an unexpected gap in the diary.

Treat an active fire, suspected gas escape or serious ongoing flood as a safety escalation, not a routine scheduling dispute. Contact the appropriate emergency service and follow its instructions; do not send an unqualified colleague into danger because the agency holds keys.

As a suggested incident record, capture what was reported, why immediate action was believed necessary, attempts to contact the occupier, who attended and what happened. Preserve the original description rather than rewriting it afterwards to make the decision look tidier.

Where urgency is disputed or the facts do not establish an immediate emergency, obtain advice about lawful access. A missed safety-check appointment deserves prompt action, but it should not simply be relabelled an emergency to bypass an access refusal.

What if a tenant refuses a gas safety visit?

HSE's tenant-dealing guidance says landlords must not use force to enter for maintenance or gas safety checks. They must be able to show that they took all reasonable steps to comply, with the approach appropriate to the circumstances and ultimately assessed by a court.

HSE recommends leaving notice of an unsuccessful attempt with contact details, writing to explain that the check is a legal safety requirement, and giving the tenant an opportunity to arrange their own appointment. It strongly advises keeping all correspondence and expects repeated attempts. See the actual guidance, rather than treating a fixed number of unanswered messages as an automatic defence.

Use a contact log that distinguishes delivery, response and attendance. “Reminder sent” does not show whether the address was correct, whether the resident proposed another time, or whether the engineer attended the agreed slot.

Start the booking process with enough room to resolve ordinary scheduling problems. Offer practical alternatives and ask whether communication, mobility, caring responsibilities or concerns about the visitor are preventing access. Escalate continuing refusal for advice rather than threatening entry with keys.

After completion, close the documentation loop. HSE requires the latest gas safety check record to reach existing tenants within 28 days of completion and new tenants before they move in. It allows electronic provision where the tenant is happy and can access it, but requires a paper copy if requested.

Use the landlord safety-document checklist for the wider record, keeping appointment evidence separate from the actual completed safety record. A booked inspection is not proof that the check happened.

What should an access request say?

Use these suggested templates with approved contact details, suitable lead time and the relevant tenancy terms. Have contested notices checked rather than relying on wording copied from a general guide.

Condition inspection request

“We would like to inspect the condition and state of repair at [property] on [date], during [time window]. [Named person or organisation] will attend to inspect [areas or purpose]. Please confirm whether this works for you, or suggest an alternative reasonable time. Tell us whether you will be present and if you need any arrangements to make the visit workable.”

Repair appointment request

“Following your report about [issue], we propose that [contractor] attends [property] on [date] during [time window] to [inspection or agreed work]. The expected access areas are [rooms or equipment]. Please confirm the appointment and whether you will provide access. If you want us to discuss entry while you are absent, contact [team]; we will record the agreed arrangement.”

Gas safety appointment request

“We need to arrange the property's gas safety check. We propose [date and time window] with [engineer or company]. Please confirm, or contact [team] to arrange a suitable appointment. If anything is preventing access, tell us so we can discuss the arrangements. We will provide the completed safety record through the agreed channel.”

Keep a single appointment owner. Before dispatching the contractor, check the tenant's latest response, scope, contact information, access method and any cancellation. Share only the information needed to arrange and carry out the visit, rather than forwarding an entire tenant conversation by default.

For channel design, the practical tenant-messaging guide explains how to keep communication handovers clear. An access request made by one colleague should remain visible when another colleague takes the follow-up call.

Aloft offers Maintenance AI, Lettings AI and Payments AI, supporting resident communications and property operations across phone, WhatsApp, SMS and email. Workflow scope depends on configuration and operator oversight. The property team still needs to confirm lawful access and retain the appointment record.

Send the contractor with an agreed access plan, not just a property address.

Frequently asked questions

Must a landlord's inspection notice be in writing?

For the statutory condition-inspection access right, the legislation specifies notice in writing to the occupier and a reasonable time of day. Keep the actual message and delivery record, not just a diary entry saying “inspection arranged”. Check the visit's purpose and the tenancy terms, and seek advice if access is disputed rather than assuming an informal conversation settles every requirement.

Can the landlord enter if the tenant does not reply?

Do not treat a lack of reply as an agreed appointment. Shelter says landlords should not enter without permission even if they hold a key. Follow up, offer an alternative and record the response. Genuine emergencies require their own safety assessment; an unanswered routine appointment request is not itself evidence of such an emergency.

Can a landlord force entry for a gas safety check?

No. HSE expressly says not to use force and requires landlords to demonstrate reasonable steps. Retain correspondence, explain the safety purpose and offer the tenant a way to arrange an appointment. Continuing refusal needs escalation and advice, not a locksmith instruction justified solely by the duty to complete the check.
