Rent Arrears Process for Letting Agents in England
Rent arrears process for letting agents in England: verify payments, contact tenants, agree repayment plans and check benefits and Breathing Space protections.

The rent arrears process for letting agents should begin by checking the rent ledger and unmatched receipts, then contacting the tenant with an accurate balance and a route to discuss support or repayment. Before escalating, check benefits, any disputed amounts and Breathing Space protections; the creditor guidance requires action on protected debt to stop when a moratorium is notified.
This guide covers early arrears management for private rented homes in England. Breathing Space also operates in Wales, but tenancy and possession rules differ there; Scotland and Northern Ireland have separate regimes. Identify the tenancy and applicable law before selecting a legal notice.
Keep collection administration separate from possession advice. A dashboard showing unpaid rent is a reason to investigate, not an instruction to issue the strongest available letter. The next action should reflect what the team has verified and what the tenant has told you.
What should a rent arrears process for letting agents check first?
On the first overdue-payment review, reconcile the charge with the tenancy record. Confirm the due date, rent frequency, relevant credits and whether any recent rent increase was validly implemented. Check bank receipts awaiting allocation, partial payments, duplicated charges and payments received under an unfamiliar reference.
These are suggested operating checks, not a statutory waiting period before contact. Do not invent a universal grace period or assume every apparent shortfall means the tenant deliberately withheld rent. Preserve the original transaction history when correcting an allocation so another colleague can understand the change.
Use a balance record containing the opening position, each charge, each receipt, adjustments and the resulting balance as at the review date. Distinguish verified debt from an amount still being investigated. If the tenant says they paid, ask for the relevant payment information and reconcile it before repeating the demand.
At the next working review, identify what remains unexplained and assign an owner. A property manager should not keep contacting the resident while accounts is separately investigating the same receipt. Put the communication history and ledger queries together, with a clear next action.
How should the first contact be written?
State the property, period, amount shown outstanding and date of the statement. Invite correction and a discussion if there is a payment difficulty. For example, use this suggested wording with the verified details inserted:
“Our rent statement shows an outstanding balance for your tenancy as at the statement date. Please check the attached breakdown. If you have already paid, tell us the payment date and reference so we can investigate. If you are having difficulty, please contact the named member of our team to discuss your circumstances and possible next steps.”
Agree a contact route and next update rather than sending repeated messages from unrelated staff. Ask whether the difficulty involves a benefit claim, changed income, a disputed charge or another issue the team needs to understand. Do not promise benefit eligibility or ask an unqualified colleague to deliver debt advice.
Avoid threats, lock-change warnings or suggestions that repairs depend on payment. The government harassment guidance says harassment and eviction without the correct process are criminal matters and identifies threats and withholding required repairs among the problems. Keep repair reports active even where the rent account is in dispute.
Record the response fairly, including disagreement. “Tenant disputes allocation and has supplied payment details” is more useful than “refuses to pay” where the transaction has not been checked. Give the landlord an accurate account of the position and the recommended next step.
What belongs in a repayment plan?
Discuss a realistic proposal with the tenant and obtain the necessary landlord authority. Distinguish continuing rent from repayments towards the existing arrears. A plan that appears affordable only because it ignores the next rent charge does not provide a useful basis for monitoring.
Use this suggested plan checklist rather than a generic promise to “catch up soon”:
Identify the tenancy, parties and balance covered, with the statement attached.
Record any disputed element separately and how it will be investigated.
State the ordinary rent amount and due dates without confusing them with arrears instalments.
Record the additional repayment amount, agreed dates and payment reference.
Identify the authorised agency contact and how the tenant can report changed circumstances.
Agree a review point and what discussion will follow a missed instalment.
Give both sides a copy and record the landlord's approval.
This is an operational outline, not a legal agreement template or a promise that proceedings automatically stop. Have any proposed contractual wording checked. Signpost independent debt advice where affordability is uncertain rather than pressuring the tenant to accept an amount they say they cannot sustain.
When an instalment is missed, check receipts again and contact the tenant through the agreed route. Record whether the cause is administrative, a change in circumstances or a breakdown in the arrangement. A missed promise should trigger a reviewed decision, not an unexamined sequence of escalating threats.
Can Universal Credit be paid directly to the landlord?
A managed payment to landlord can be considered where arrears equal at least 2 months' rent, or where continual underpayment over more than 2 months has produced arrears of at least one month's rent. Other vulnerability factors can also justify consideration, so those thresholds are not the only route. The alternative payment arrangement guidance makes decisions case-specific.
Either the claimant or landlord can request a managed payment. Landlords use the Apply for a Direct Rent Payment service; the DWP guidance explains the application, tenant objections and decision process. A request is not confirmation that the landlord will receive payment, and it does not itself clear historic arrears.
Distinguish housing-cost payments from deductions towards arrears. Track the decision, payment period and receipts separately so an application does not appear in the ledger as cash already collected. DWP's landlord guide also warns that a tenant's housing support may not cover their full rent.
Help the tenant obtain accurate rent evidence where needed. The landlord guide describes evidence of liability and occupation, including a landlord or agent letter in appropriate circumstances. Keep the information consistent with the actual tenancy and rent account.
What changes when Breathing Space is notified?
A standard Breathing Space can protect someone in problem debt for up to 60 days. A mental health crisis Breathing Space lasts through the qualifying treatment and a further 30 days. These are different protections, not interchangeable expiry assumptions, as the creditor guidance explains.
When notified, identify the protected debt and apply the protections immediately as required by the notification. Stop automated demands and prohibited enforcement relating to it, inform relevant colleagues and agents, and use the named debt adviser for questions. The creditor guidance describes creditor responsibilities and restrictions; do not treat the scheme as merely a note on the contact record.
Rent arrears can qualify, while ongoing rent remains payable. Existing court proceedings and mixed balances need careful handling rather than assuming every legal step is cancelled or every new charge is protected. Shelter's explanation distinguishes these stages. Refer a live possession case to its adviser and notify the court where required.
When should an arrears case move towards legal review?
For covered England private tenancies, Ground 8 requires at least 3 months' rent unpaid for monthly payers, or 13 weeks for weekly or fortnightly payers, both at notice and hearing. The notice period is 4 weeks. The government grounds guide sets out these conditions; reaching a balance on a dashboard does not itself establish a right to possession.
Delayed Universal Credit needs specific checking in that calculation. Where DWP has decided housing costs are payable but the tenant has not received them, the relevant amount should be excluded from the arrears assessment for this ground. Citizens Advice explains the special rule. Do not describe every hoped-for or pending benefit application as an established entitlement.
Grounds 10 and 11 address arrears and persistent delayed payment respectively, with 4 weeks' notice; they are discretionary, so the court considers reasonableness. See the government grounds guidance. Obtain case-specific advice on the ground, evidence, tenancy history and protections before serving a notice.
Give the adviser the tenancy, rent statement, receipt evidence, contact history, plans, benefits information, dispute details and moratorium notifications. Keep records factual and preserve documents as supplied. For the broader tenancy reforms, use the letting agents' operating checklist; for communication handovers, see the tenant messaging guide.
Aloft's Payments AI supports a rent ledger, receipt matching, arrears classification and promise-to-pay tracking, with availability depending on organisation configuration. Decisions about tenant contact, repayment proposals and legal notices remain with the agency and its advisers.
Escalate a verified case, not an unexplained balance.
Frequently asked questions
What should an agent do when a tenant stops paying rent?
Check the account and receipts before contacting the tenant with an accurate statement. Discuss the reason, a workable response and independent advice where needed. Check for benefit issues and notified protections before escalation. The DWP landlord guide encourages early engagement, while the Breathing Space guidance explains when collection action must stop.
Does a repayment plan replace ordinary rent payments?
A practical plan should distinguish the ordinary rent from additional repayments towards arrears. Record both schedules and make the total commitment clear before agreement. Do not treat this suggested record format as legal advice about changing contractual obligations. Where Breathing Space applies, ongoing rent remains payable, as Shelter explains; protected arrears require separate handling.
Is a managed payment to landlord guaranteed?
No. DWP considers the request and relevant circumstances, including the tenant's opportunity to object. The alternative payment arrangement guidance explains who can apply and how decisions are made. Keep the request, decision and actual receipts separate in the account, and do not promise that direct housing-cost payments will cover all rent or repay the existing arrears.
